The findings say investigators determined the troopers believed Ward posed an immediate danger.
New Hampshire Attorney General John Formella has concluded that five state troopers acted lawfully when they shot David Ward during a lengthy standoff in Keene last year.
Ward, 57, of Keene, died on Aug. 12 in a parking lot near TD Bank on West Street after police confronted him while trying to serve a warrant, according to authorities. Officials said he was armed and remained inside a parked vehicle for hours before the encounter ended in gunfire.
The decision covers the actions of N.H. Police Sgt. Noah Sanctuary, Sgt. Nicholas Levesque, Sgt. Aramus Caraballo, Trooper Matthew Dushame and Trooper Jacob Hunt. Formella’s office said the officers’ use of deadly force was justified under state law after a review of the available evidence.
The findings say investigators determined the troopers believed Ward posed an immediate danger when he suddenly got out of the vehicle carrying a handgun after the extended standoff.
