Police said the homeowner or residents used a firearm in self-defense during the confrontation, and the suspect later received treatment for a minor leg graze wound. Police identified the man as Joseph C. Gardner, 54, of Pownal. He was charged with burglary after officers said he entered the residence without permission at about 5:37 AM and then got into a physical altercation with Ryan Cote, 41, and Joyce Colegrove, 42, both of Pownal.

Gardner was taken by the Pownal Rescue Squad to Southwestern Vermont Medical Center before being booked at the Vermont State Police barracks in Shaftsbury. Authorities said he was not held on bail ahead of his court date.

Investigators said the Bennington County State’s Attorney’s Office will review the case to decide whether any additional charges should be filed connected to the gunfire. Police also noted that Vermont law 13 VSA 1305 may protect a person who reasonably believes deadly force is needed to stop an imminent threat during certain violent crimes, including burglary and robbery.

Gardner is set to be arraigned at 12:30 PM Monday, July 6, in Bennington Criminal Court.
